I looked around the forums but couldn't find a thread with this question. On google SERPs, there are sometimes 2 different areas where sponsored links appear 1 on the top with a yellow background and on the right hand side.

My question is, are they the same thing?

A client of ours is looking to get sponsored links to his keywords on the top sponsored area.

In essence, they are the same. Animated3D is right, but it's not only based on how much the advertiser is wiling to pay, but on another factor called Quality Score. Sponsored Links have their own algo that rewards ads for high click through rates,
