I have a problem with Link Share and short of filing a law suit I am wondering what my options are.

Someone from another country (Latvia?) has set-up an account at Linkshare.com and they claim my web site Outdoors-411.com is theirs. I have contacted LinkShare and they refuse to shut this guys account down even though they acknowledge the domain and site belong to me. They say it is perfectly fine and legal for someone to set-up an account with them and claim ownership of ANY domain. As a matter of fact they said it would be fine if I set-up an account and said Microsoft.com was mine.

What this guy appears to be doing is sending out millions of spam e-mails with the tracking codes as if it came from my web site! How can I stop this?

I have already received two inquiries from Link Share "Merchants" wondering about the huge number of impressions with very low click-through rate. When explain what is happening one somehow thinks it's my fault, the other said they were going to discontinue their relationship with LinkShare.

What can I do with out getting the ambulance chasers involved? Or should I just file a suit against LinkShare since they are a willing party to this fraudulant deception?

So how do you know this person has a Linkshare account with your site in it? How will LS shutting down that account help the situation?

Just trying to understand...

No, they are his LinkShare links. BUT, he is using my domain name in his account. So when people look at his account they think his domain is Outdoors-411.com when he actually doesn't have anything to do with the site. Affiliate tracking is not done by domain, it's done by account numbers.

So how do you know this person has a Linkshare account with your site in it?

I called LinkShare trying to find out what was going on and they told me there are two accounts associated with my domain Name. PLUS, the last person that called me inquiring about the really high number of impressions with the really low number of click throughs told me where the checks were going to and the persons name.

How will LS shutting down that account help the situation?

Because people will no longer be duped into thinking that my site is advertising their products. Besides that how is it legal or even practical to allow anyone and everyone to claim ownership of any web site they find attractive?

I'm sure there are lots of other websites being used illegally also. LinkShare is making a ton of money by allowing people to use any domain name they want, they are no better than the guys doing this and are more than likely involved in the deception on a deeper level.
