I have recently launched a site which has very obscure keywords and has one major competitor. The maximum CPC has increased from €2 to €8 over the space of 4 weeks since we launched with only 2 advertizers. I have tried setting up position preferences very low 7-10 but because there are only 2 advertisers I always end up in the blue zone and paying Max CPC. There are no alternative keywords.
Is this something I just have to live with?
The incumbent can obviously afford these rates - what are my options?

Although Google Reps have repeatedly told me verbally that position preference will keep ads out of positions that does not work. I have never been able to prevent their system from moving ads into those preferred spots with position preference. The only effect that feature seems to have is to reduce traffic so I stopped using it.
If you only have one competitor why are you bidding so high? I would definitely experiment with different bids. If there are only two ads showing try bidding the minimum required to keep the keywords active and see if you're still number two.
If you mean they're setting really high minimum bids for your keywords, sometimes bidding low and letting them sit there for a day or two will start them running; other times Google's system will not run them for less.

Just to clarify, Google introduced position preference for those advertisers who want to display their ads only when they're in specific positions or not at all.
I'm sure they think advertisers want to only display their ads when they're in HIGH positions while my intent is to keep my ads OUT of those positions. Both bidjob and I wanted to use that feature for a different purpose than Google thought we would.

Thank flyingrose - Minimum bid has increased to €8 - that is why I have set it so. Even then I alway pay the max - surely the Avg CPC should be lower - is there any point escalating to Google or will they just fob me off with 'improve the quality of your keywords' line?

You'll probably just get their canned response. Do you have very specific keywords with the keywords in the titles of the ads and landing on pages that include that phrase?
Are you using title tags on your pages? That is important to organic placement and getting free traffic and appears to be a major factor in Google's quality score.
